These Terms and Conditions (hereinafter: Terms) explain the rights and obligations
BETWEEN
Mindfinitely
Kitti Szamosi IE Entrepreneur Individuel (hereinafter Coach) acting as Mindfinitely N° Siret: 948 364 211 00011 (hereinafter, collectively: Mindfinitely, we, us, our)
AND
Client
visitors, users, clients (hereinafter you, your, Client)

who access or use the mindfinitely.com website (hereinafter: Website) or
-
who book, use or buy RTT hypnotherapy or RTC coaching sessions (hereinafter: Sessions) or events (hereinafter: Events), offered in the Website (hereinafter collectively: Services)

via Zoom or any other online platforms (hereinafter: Call).
Mindfinitely and Client are hereby referred together as Parties.
Your access to and use of the Services and the Website is conditioned on your acceptance of and compliance with these Terms.
By accessing the Website and/or using the Services you agree to be bound by these Terms as well as our Privacy Policy. If you disagree with any part of the Terms then you may not access the Website and/or use the Service.
Working Online
By purchasing the Service, Clients consent to work online through Zoom or any other similar online system mutually agreed by the Parties. Client makes sure that the mutually agreed online system has been set up on their computer and it works correctly.
The Session is just as effective online as it is working face to face. However, for uninterrupted connection, Clients must ensure that they are connected to Zoom with Wi-Fi and stay close to the router. Clients must ask family members or roommates not to play online games or download content from the internet during the Session in order to benefit from a continuous strong signal.
The Session almost always involves a deep relaxation exercise when Clients have their eyes closed and cannot adjust the screen or hold a mobile device in their hand. It is of utmost importance for a quality Service for the Coach to see the Client’s face and torso during the whole time. Hence Clients must refrain from joining the Call by using a mobile phone or tablet.
For the Coach it is crucial to see Client during the whole Session. Therefore if the previewed end time of the Call is an hour in the Client’s time zone when there is no more daylight, it is Client’s responsibility to switch on the lights in the room before the session starts.
For the purpose of an uninterrupted Session, Client undertakes to activate silent mode or switch on the do not disturb mode on the computer and on all their electronic devices around them. Client’s computers must be plugged in so that the battery does not run out during the Session.
In a relaxed visualization or in hypnosis the quality of the audio is of utmost importance. When being in a light trance state, Clients might lean back from the microphone so in order to avoid the interruption of the sound, Client undertakes to connect using headphones during the Call in order to ensure a perfect voice quality.
Mindfinitely has the right to refuse to work with the Client or discontinue the Session if any of the obligations set out in this Working Online section is not respected. If the Session must be interrupted due to the not compliance of the above requirements, no extra time or refund is provided and a new Session needs to be booked and paid by the Client.
Standalone Sessions
Standalone Session means one individual call purchased without a Package. Clients can purchase a standalone Session if it is displayed on the Website. The Session is based on the method of either Rapid Transformational Coaching (hereinafter: RTC) or Rapid Transformational Therapy (hereinafter: RTT or RTT hypnotherapy) according to the mutual consent of Coach and Client. The fee for the standalone Session is non-refundable.
Packages
Clients can purchase a package of Sessions if it is displayed on the Website (hereinafter: the Package). Packages can be used for 3 months starting from the date of purchase. The Packages are registered in the name of the individual who purchased them hence the Sessions cannot be transferred to a third party, they can only be used by the Client.
Packages can be cancelled anytime. In such a case, Client is entitled to a refund for the remaining Sessions according to the cancellation conditions below. For clarity, no refund is possible for the Session that had already taken place.
Package Cancellation and Refund
Sessions in a Package are offed at a discounted price. Such price is in force as long as Client uses all the Sessions included in the Package. This means that if Client cancels its subscription, refund is calculated for the remaining sessions with the non discounted price without the use of a coupon code.
For example if a Standalone Session is 250 Euro and the Client purchased a package of 8 sessions for a discounted price of 1.000 Euro and cancels after 1 Calls, the refund is 750 Euro and not 875 Euro as the price of the Sessions are calculated at the original price (250 Euro) and not on the discounted price (which is 125*8=1000 Euro).

Events
Clients can purchase a ticket for workshops or any other Events displayed on the Website. Client understands that the purpose of these group Events is personal development that can provide insight but it is not a one on one therapeutic or coaching Session. The fee for the Events is non-refundable.
Timekeeping
The durations of the Sessions are always indicated on the Website and they are non-extendable except as specified hereunder.
The Parties undertake to join the Call on time and start the Session at the scheduled hour. In case Client joins the Call late or the Session cannot be started on time due to Client’s omissions (including but not limited to the circumstances detailed in the Working Online section) the duration of the Session shall not be extended and no refund is possible.
Coach shall always join the Call on time. In the unlikely case that the Session cannot be started as a result of the Coach not joining the Call on time or having technical difficulties, after 10 minutes of being late, the Client has the option to choose from extending the Call or postponing the Session free of charge.
Session Cancellation and Rescheduling
Coach shall not cancel or postpone a Session once it has been confirmed to the Client except if it had been booked due to a system error as detailed later in these Terms. However, in case of serious technical problems i.e. breakdown of the Website, no internet connection at Coach’s premises, or if an illness seriously affects Coach’s capacity to provide quality Service to the Client, Coach must inform Client accordingly without delay, postpone the Session for a date and time chosen by Client without any fee incurred.
Client has the right to cancel or reschedule the Session 24 hours prior to the start of the Call. Client understands that not joining a Call or canceling it within 24 hours of the scheduled starting time shall be counted as a completed Session and no refund or rescheduling is possible.
If Client is not able to attend an Event, the date cannot be changed or rescheduled and no refund is granted of the paid fee. In case an Event is cancelled by Mindfinitely, the fee shall be refunded to Clients in a reasonable deadline or Client may be offered a possibility to be registered for another event, according to the choice of the Client.
Professional Conduct of Service
Coach is a certified in Rapid Transformational Coaching (RTC) and holds the title of Certified Hypnotherapist in Rapid Transformational Therapy (RTT) which are accredited methods in several countries all over the world.
Coach abides by the Rapid Transformational Coach (RTC) and Rapid Transformational Therapy (RTT) Ethical Code of Conduct and standards of behavior, further to the Code of Conduct and the Quality Charter of the Accredited Counselors, Coaches, Psychotherapists and Hypnotherapists (ACCPH) and at all times will act with integrity, responsibility, competence, respect and professionalism.
Coach undertakes to to use the RTT and the RTC methods with the highest diligence and provide the Service with professionalism and with the absolute goal of helping Clients to achieve their goals.
Nevertheless, the result of the Service is highly dependent on the motivation and involvement of the Client as well so Coach shall not guarantee any outcome of the Sessions.
Mutual Respect
The Parties are obliged to show mutual respect to each other when working together and keep professional boundaries.
Clients joining the Call under the influence of substances or alcohol cannot take part in the Session and no refund shall be granted in this case.
No Substitute for Medical Treatment
The Sessions are not equivalent to a medical treatment. Client must not change or stop their medication or their medical treatment unless in agreement with their prescribing doctor.
Mental Health Problems
Client confirms not to have been diagnosed and or does not disclose any of the conditions as follows: auditory/visual hallucinations, dissociative disorders, personality disorders, psychosis, schizoaffective disorder or schizophrenia. Performing the Service on Clients who have the mentioned conditions may cause harm to their mental state therefore Mindfinitely takes no responsibility for any adverse event resulting from the Service due to Client’s untrue declaration as to their mental health.
Confidentiality
All the information shared by the Client on the Website or during the Session or anyway in relation to the Service shall be treated confidentially and with the highest diligence. Client’s information shall be used for the sole purpose of providing the Service and never be shared with third parties.
Client’s information can be shared on a need to know basis with Mindfinitely’s service providers under proper confidentiality agreements, in case of safeguarding concerns or lawful requests of the relevant authorities. For more information on the data protection please consult our Privacy Policy.
Liability
Client agrees that, except for death and personal injury arising from our negligence, we shall not be liable in contract, tort, negligence, statutory duty or otherwise, for any loss or damage whatsoever arising directly or indirectly from or in any way connected with the Website or the use of the Services. In any case, Mindfinitely shall be liable to the Client only up to the amount of the total fee paid for the Service.
Intellectual Property Rights
Clients acknowledge that all copyrights, trademarks and all other intellectual property rights on the Website or otherwise related to the Service, including but not limited to the mindfinitely® trademark, the logo, the mindfinitely.com domain name, the images, the photos, the audios and the content and the copyrights related to the Website or our social media shall remain vested in Mindfinitely. Any unlawful or unauthorised use of our intellectual property shall be prosecuted before the relevant courts or authorities.
Communication
The Parties communicate with each other by email or by the chat provided on the Website. Coach takes all reasonable efforts to respond to the emails or questions within 48 hours.
Payment
By purchasing a Service, you hereby authorize Mindfinitely to charge the cost of the Service indicated on the Website to your credit card. We do not store your credit card data on our Website or in our database. Our third party service provider stores your payment data with the highest confidentiality measures and will use these details only for the purpose of providing the service on our behalf. All payments and amounts shown on the Website are in Euro.
Incorrect Price
Despite our reasonable efforts, Services may occasionally be listed at an incorrect price including but not limited to the use of an expired or otherwise erroneous coupon code. If this happens, Mindfinitely retains the right to cancel the transaction and refund the fee payed to the Client without performing the Service.
System Error
We may cancel or reschedule the appointment that had been booked due to a system error. In this case, we contact Client and find a new date and time that suits the best for both Parites.
Links To Other Websites
The Website may contain links to third-party websites, contents or services that are not owned or controlled by Mindfinitely. Therefore Mindfinitely assumes no responsibility for the content, privacy policies, or practices of any third-party contents. You further acknowledge and agree that Mindfinitely shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.
Severability
If any provision of these Terms is unlawful, void or unenforceable, it shall not affect their validity and enforceability of the remaining provisions. Such provision will be replaced by a provision that most closely reflects the meaning of the unlawful, void or unenforceable provision.
No Waver
The failure Mindfinitely to enforce any provision of these Terms will not constitute or be construed as a waiver of such provision or of the right to enforce it at a later time.
Changes of Terms
Mindfinitely may change these Terms from time to time. We encourage you to visit the Website to stay informed. If the changes are material, we may provide you additional notice to your email address or through the Website. Your continued use of the Services indicates your acceptance of the modified Terms.
Plural and Singular
Words used herein in the singular, where the context so permits, shall be deemed to include the plural and vice versa. The definitions of words in the singular herein shall apply to such words when used in the plural where the context so permits and vice versa.
Headings
The headings of these Terms are for convenience of reference and shall not form part of, or affect the interpretation of, these Terms.
Governing Law and Jurisdiction
These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation, shall be governed by, and construed in accordance with, the laws of Hungary. Each Party irrevocably agrees that the courts of Hungary shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms or its subject matter or formation.
